    People seem to be under the impression that any time a person lays his hands on another person, it’s assault. Legally speaking, that’s just not true.

    Assault means that the first party, the aggressor, acts in a way as to demonstrate a willful intent to make harmful or offensive contact against the other person (the “victim”). Secondly, the “victim” must be perceive that the other party means to cause him serious harm or make offensive contact. By both parties agreeing to enter into contact with each other, the two parties perceive that neither wishes to do the other serious harm, but rather each is intent to score points or achieve a winning result.

    Now, there are cases in which one person midway begins to intend harm and the other person, by the change in the aggressors demeanor, perceives harm or offensive contact to be imminent. At this point, it becomes assault (Think Tyson vs. Holyfield II).
